Judge Richard D. Taylor Jr. today declared a mistrial in the case against Willie N. Hayden Jr. in the shooting deaths of Tyeron Massenburg, 22, and Ikia M. Goodman.

But the case is not over. Hayden will stand trial later this summer.

Hayden is accused of shooting Massenburg as he drove through a South Richmond neighborhood last September. Goodman was a bystander and was fatally wounded, police say.

The mention of an earlier shooting risked improperly prejudicing the jury in the murder trial, one of Hayden's lawyers, David Lassiter, argued today.

Judge Taylor agreed, and declared the mistrial.

Meanwhile, the commonwealth's attorney's office has filed additional charges, including three counts of attempted murder for each of the other passengers in the car in which Massenburg was riding.
